Perlindungan Hukum Bagi Penerima Manfaat Pensiun yang Mengalami Keterlambatan Pembayaran Sehubungan dengan Likuidasi dan Pembubaran Dana Pensiun Pemberi Kerja Sinar Kasih

Penelitian ini membahas perlindungan hukum bagi penerima manfaat pensiun yang mengalami keterlambatan pembayaran akibat likuidasi dan pembubaran Dana Pensiun Pemberi Kerja (DPPK) Sinar Kasih. Permasalahan utama penelitian ini berkaitan dengan penyebab terjadinya likuidasi, tanggung jawab pendiri dan/atau pemberi kerja, serta bentuk perlindungan hukum bagi peserta, pensiunan, dan pihak yang berhak atas manfaat pensiun. Tujuan penelitian ini adalah untuk menganalisis dan menguraikan bentuk perlindungan hukum serta hak-hak peserta DPPK Sinar Kasih sehubungan dengan dilakukannya likuidasi dan pembubaran, serta untuk menganalisis dan menjelaskan bentuk tanggung jawab pendiri dan/atau pemberi kerja ketika terjadi keterlambatan pembayaran manfaat pensiun sebagai akibat dari proses likuidasi dan pembubaran tersebut. Penelitian ini menggunakan metode penelitian hukum doktrinal dengan pendekatan perundang-undangan dan studi kasus. Data yang digunakan berupa data sekunder yang diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, dokumen hukum, dan literatur yang relevan. Hasil penelitian menunjukkan bahwa keterlambatan pembayaran manfaat pensiun terjadi karena kondisi pendanaan yang memburuk, ketidakmampuan pemberi kerja memenuhi kewajiban iuran, serta proses likuidasi yang membutuhkan inventarisasi aset, verifikasi kewajiban, audit, dan perhitungan aktuaria. Kondisi tersebut berdampak pada kepastian hukum, stabilitas ekonomi peserta, dan efektivitas perlindungan konsumen di sektor jasa keuangan. Penelitian ini menegaskan bahwa perlindungan hukum terhadap penerima manfaat pensiun harus diperkuat melalui pengawasan Otoritas Jasa Keuangan, transparansi proses likuidasi, akuntabilitas tim likuidasi, serta penegasan tanggung jawab pendiri dan pemberi kerja dalam memenuhi hak peserta.
